TALENTPORT PTE. LTD.

1. Introduction

This Talentport website (“Site”) is operated by Talentport Pte. Ltd. (“Talentport”, “we”, “us”, and/or “our”) to provide our users (“you” and “your”) with information about Talentport and its services.

Talentport is used by Job Seekers (“Job Seekers”) who wish to offer their services (“Services”) and clients who need the Services (“Clients”). Job Seekers that have passed our screening process and are admitted to our network of professional Job Seekers (“Network”) are referred to as “Talent”. For purposes of this Privacy Policy, the term “Job Seekers” is broader in scope and includes both Talent and Job Seekers who are not Talent. 

2. Scope

In this Privacy Policy, we sets out how we collect, store and use personal data of our users (“Personal Data”). This Privacy Policy also covers data that Talentport collects in-person, for instance at business conferences and trade shows.

3. Job Seekers 

3.1. Information We Collect

Information That You Provide To Us

If you are applying for the site as a Job Seeker, you are asking to be admitted to our Network. We will perform a screening process that assesses your language skills, personality, domain-specific knowledge, abilities, and professionalism in order to add you to the network and fit your qualifications to the needs of your clients. Depending on the client's request, it may be necessary to screen potential Job Seekers for specific technical skills. In this context, you will be asked to provide information about yourself, which includes but is not limited to your name, address, contact information, and work experience.

Information You Share

If you participate in the Talentport features on the Site, we collect information you choose to share in that context.

Profile Creation

We use certain Personal Data about you to enable you to create a profile that appears within the Service. Your profile is searchable and can be viewed by Clients.

3.2. How We Use the Information

To Provide Service And To Respond To Requests

Talentport uses the Personal Data you provide in compliance with this Privacy Policy. If you provide Personal Data for a specific reason, we will use the Personal Data in connection with that reason.

We use the Personal Data you provide to us in particular to handle your application to become a Job Seeker and to administer our contract with you once you join the Network. For individuals in the EU and the UK, our use of Personal Data that you provide to us is required in order to implement your request to become a Job Seeker prior to entering into a contract with us and, once you are admitted to the program, to carry out your duties as a Job Seeker.

As Required For Particular Legitimate Interests

We use your Personal Data for the legitimate interests described below:

  • To comply with legal obligations and to respond to requests from public and government authorities.
  • To send you information regarding the Site, such as changes to our terms, conditions, and policies.
  • To prevent criminal activity, misuses of our services, and protect our IT systems and networks.
  • We use data relating to your use of and interaction with the Site and the Services, to provide you with personalized services based on your experience with our Services.
  • To send you administrative information, such as information about the Site and changes to our terms, conditions, and policies.
  • If you request to delete your data and we are required to do so, we will keep basic information to identify you and prevent further unwanted processing.

Marketing Purposes

We may use your contact information to inform you about services we believe you will be interested in, upcoming events, or other information. If we do this, each marketing communication we send you will include instructions for "opting out" of future marketing communications. However, as a user of our services, you are unable to opt out of certain administrative communications that are reasonably necessary to the services, such as billing or service notifications. 

4. Clients

4.1. Information We Collect

Information that you provide to us

When we receive a request to hire one of our Job Seekers, we collect Personal Data from our prospective Clients. This includes the names and contact information of prospective Client's representatives, as well as any information pertaining to the Client's requirements.

Automatically Collected Data

When you interact with Talentport through the Site or services, we automatically collect particular information. Please read the “Site Visitor” section below for more information.

Information Obtained From Third Parties

We may add the information we collected from you with additional information about you and your company, which we obtained from third-party databases or services that provide such information. 

4.2. How We Use the Information

To Provide The Services And Respond To Requests

Talentport uses the Personal Data you provide in accordance with this Privacy Policy. If you provide Personal Data for a specific reason, we may use the Personal Data in connection with that reason. For example, if you contact us via email, we will use the Personal Data you provide to respond to your inquiry or resolve your issue.. In addition, if you provide Personal Data in order to gain access to the Services, we will use your Personal Data to provide you with access to such Services, maintain your account, contact you about your use of the Services and/or the Site or to notify you of significant changes to the Services and/or the Site, and monitor your use of such services. For individuals in the EU or the UK, such use is required to respond to or implement your request, as well as to carry out the terms of the contract between you and us.

5. Job Applicants

5.1. Information We Collect

Application and assessment process

When you submit a job application on our Site, our recruiting service provider will collect the Personal Data that you include in your resume and cover letter. You may wish to include the following information: your name, contact information, employment history, and education.

If you are invited to participate in further assessments in connection with your application and you do so, we will collect additional Personal Data that you provide to us as part of that process. You may disclose information about your qualifications as well as information about your employment experience. You have the option of disclosing your salary history or salary expectations. If you fail to provide us with requested information, we may be unable to assess your suitability for a role with us, or we may be unable to make you an offer of employment. We may record your interview(s) with your prior consent in order to more accurately assess your candidacy and for training purposes.Your consent is voluntary, and you may withdraw your consent at any time, including during the interview. If you withdraw your consent or do not consent, it will have no impact on your candidacy.

We have a legitimate interest in facilitating the interview process and communicating offers of employment to you, making informed recruitment decisions and selecting suitable candidates for roles with us, and improving our recruiting and hiring processes.

We will keep your contact information and resume in order to inform you of current and future job opportunities (except if you tell us you prefer that we not keep your information for that purpose) because it is in our legitimate interest to do so.

If your application is approved

If your application is approved, we will collect additional Personal Data about you in order to conduct reference and background checks, as required or permitted by applicable local law (including if applicable to you special categories of Personal Data, and your consent to the collection of such additional data will be solicited at such time, pursuant to applicable laws). We may also collect copies of relevant identification documents from you (such as your passport or driving license, proof of address, a copy of your work permit, etc). We use this information to comply with immigration requirements and to verify your identity for our own internal security purposes. We have a legitimate interest in collecting and using this data to comply with our legal obligations and for the performance of your employment contract with us.

When our Client hires you, your Personal Data will be included in your employee record in accordance with our employee privacy policies.

Automatically Collected Data

We automatically collect certain information when you interact with Talentport via our Site in relation to your application. For more information, please see the "Site Visitors" section below.

6. Site Visitors

Our servers record information ("log data") about you as a visitor to our Site, which include information that your browser automatically sends anytime you visit the Site, such as  your Internet Protocol ("IP") address (which allows us to determine the country from which you are connecting when you visit the Site), browser type and settings, and the date and time of your request.

When you interact with the Site or the Services (whether as a Job Seeker, as a Client, a job applicant, a blog reader, or other visitor to our Site), we and our service providers acting on our behalf will automatically collect information about you through cookies (small text files placed on your device) and other technologies. 

If the information we collect automatically on our Site is Personal Data, we use it because it is important for the purposes of maintaining the safe operation of our Site as well as learning how Site visitors interact with our Site in order to improve your use of it.

7. Events

When you attend one of our events, we may collect Personal Data from you. We collect data that you voluntarily provide to us. We will use this information to establish a business relationship and in accordance with the purpose for which you provided the information.

Where applicable law requires it (for example, if you live in the EU or the UK), we will obtain your consent before or when sending you marketing information via email.

8. Our Disclosure of Your Personal Data and Other Information

Talentport does not sell your personal information. This information is a crucial part of our relationship with you. However, there are some circumstances in that we might share your Personal Data with third parties, as detailed below:

Business Transfers

Personal Data may be transferred as part of the transferred assets in the event of a corporate sale, merger, reorganization, dissolution, or similar event.

Agents, Consultants and Other Service Providers

Talentport occasionally hires outside companies to perform specific business functions. These parties include website analytics companies, digital advertising service providers, our hosting and cloud computing service providers, CRM, marketing, and sales software solution providers, billing and payment processing service providers, and background check service providers. When we hire another company to perform a function like this, we only provide them with the information they need to do their job. These parties may access, process, or store Personal Data in the course of performing their duties to us and solely to provide the services we have hired them to provide, as per our instructions.

Legal Requirements

Talentport may disclose your Personal Data if required to do so by law or in the good faith belief that such action is required to comply with a legal obligation, to protect and defend Talentport's rights or property, to act in an emergency to protect the personal safety of Site users or the public, or to protect against legal liability.

9. EU and UK Individuals

Scope

This section only applies to residents of the United Kingdom and the European Union. Our Privacy Policy describes why and how Talentport collects, uses and stores your Personal Data, the lawful basis on which your Personal Data is processed, and what your rights and our obligations are in relation to such processing.

Data Controller

For the purposes of processing your Personal Data, Talentport is the data controller. We are in charge of deciding how Personal Data about you will be used.

Your Rights

Subject to applicable EU and UK law, you have the following rights in relation to your Personal Data:

  1. Right of access. We will confirm whether we are processing your Personal Data and, if so, provide you with a copy of that Personal Data as well as certain other details if you ask. If you need more copies, we may have to charge a reasonable fee.
  2. Right to erasure. You have the right to request that we delete or remove your Personal Data, for example, if you withdraw your consent. If we share your data with others, we will notify them of the erasure as soon as possible.
  3. Right to rectification. You have the right to request that it be corrected or completed if your Personal Data is incorrect or incomplete. If we share your Personal Data with others, we will notify them of any changes as soon as possible.
  4. Right to data portability. You have the right to obtain from us any Personal Data that you voluntarily agreed to give us or that was provided to us as part of our contract with you. Your Personal Data will be delivered to you in a structured, commonly used, and machine-readable format. You are free to use it elsewhere.
  5. Right to restrict processing. In certain circumstances, such as when you contest the accuracy of the data or object to its processing, you may request that we restrict or "block" the processing of your Personal Data. We will notify you before removing any processing restrictions. If we have shared your Personal Data with others, we will notify them of the restriction as soon as possible. 
  6. Right to withdraw consent. If we make decisions based on your consent to process your Personal Data, you have the choice to withdraw that consent at any time, however this will not affect any previous processing of your data.
  7. Right to lodge a complaint with the data protection authority. If you have any concern regarding our privacy practices, including how we managed your Personal Data, you can report it to the appropriate data protection authority.

Legitimate Interest

"Legitimate interests" refers to our interests in managing and operating our organization and providing you with the best Services possible. This Privacy Policy explains when we process your Personal Data in order to pursue our legitimate interests, what those interests are, and what your rights are. Unless we have your consent or the activities are otherwise required or permitted by law, we will not use your Personal Data for activities in which the impact on you outweighs our interests. You have the option to object to processing done in our legitimate interests.

Data Retention

Our policy is to retain your Personal Data for no longer than is reasonably necessary to complete the intended purpose for which it was collected and processed, including to meet any legal, regulatory, accounting, or reporting requirements. If you have selected to receive marketing communications from us, we will retain information about your marketing preferences until you opt out and in accordance with our policies.

Data Transfers

Talentport is based in Singapore. When you apply as a Job Seeker or use our services as a Client, or otherwise use our Site, your Personal Data will be transmitted to servers in the Singapore as necessary to provide you with the services that you requested, administer our contract with you or to respond to your requests as described in this Privacy Policy, and the data may be transmitted to our service providers supporting our business operations (described above). Singapore may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located.
